Terms & Conditions
Please read these terms and conditions carefully before engaging Apex Service and Repairs for any services.

1. Introduction
These Terms and Conditions ("Terms") govern the provision of services by Apex Service and Repairs Pty Ltd (ABN 20 694 777 485, ACN 694 777 485), trading as Apex Service & Repairs ("we", "us", "our", "Apex"), to you, the customer ("you", "your", "Customer").
Apex is a Motor Repair Business licensed under the Motor Vehicle Repairers Act 2007 (WA), licence number MRB13027.
By engaging our services, requesting a quote, authorising work, or booking an appointment (whether in person, by phone, email, or through our website or in-house booking system), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not engage our services.
These Terms are in addition to, and do not exclude, restrict or modify, any rights or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable legislation.
2. Our Services
Apex Service & Repairs is a specialist caravan and trailer workshop operating from Unit 1, 6 Emerald Road, Maddington WA 6109. We provide the following services (this list is not exhaustive):
- Caravan & Trailer Repairs — structural repairs, water damage restoration, chassis work, suspension, brakes, bearings, electrical, plumbing, gas compliance, and general fault diagnosis.
- Custom Fabrication — steel, aluminium, and composite fabrication including custom trays, canopies, storage solutions, and structural modifications.
- 3D Printing — in-house 3D printing of replacement parts, custom brackets, fittings, and bespoke components for caravans and trailers.
- Solar & Electrical Accessories — solar panel installation, battery systems, inverters, DC-DC chargers, lighting upgrades, and electrical accessory fitting.
- Interior Customisation — layout modifications, cabinetry, upholstery, and fit-out upgrades.
- Annual Servicing & Servicing — pre-trip inspections, annual servicing, safety checks, and preventative maintenance.
All work is performed by qualified and experienced technicians under the supervision of the business owner. We reserve the right to refuse any job at our discretion.
3. Quotes & Pricing
3.1 Estimates vs Fixed Quotes
We provide two types of pricing:
- Estimates — an approximate guide to the likely cost of work. Estimates are not binding and actual costs may vary depending on the scope of work once the vehicle is inspected. We will contact you if the cost is likely to materially exceed the estimate before proceeding.
- Fixed Quotes — a firm price for a defined scope of work. Fixed quotes are valid for 30 days from the date of issue unless otherwise stated. A fixed quote covers only the work expressly described in the quote document.
3.2 Labour Rate
Our standard labour rate is $155.00 per hour (inclusive of GST). Labour is charged in 15-minute increments. The standard work day is 7.5 hours.
3.3 Parts & Materials
Parts and materials are charged at cost plus a reasonable markup to cover sourcing, freight, handling, and warranty administration. Where possible, we use genuine or OEM-equivalent parts. If you request specific parts or brands, additional costs or lead times may apply.
3.4 Additional Work
If, during the course of authorised work, we discover additional issues that require attention ("hidden problems"), we will contact you for approval before proceeding with any additional work. Additional work will be quoted separately and requires your authorisation before commencement.
3.5 GST
All prices quoted by Apex are inclusive of GST unless expressly stated otherwise. A valid tax invoice will be provided for all completed work.
4. Authorisation of Work
No work will commence on your vehicle until you have provided written or digital authorisation. Authorisation may be provided by signing or initialling a physical job card, or by providing a digital signature through our in-house booking system.
A digital signature provided through our booking system constitutes a legally binding agreement in accordance with the Electronic Transactions Act 2011 (WA) and has the same legal effect as a handwritten signature.
By authorising work, you agree to the following terms, which are presented on the booking job card:
By authorising work, you warrant that you are the legal owner of the vehicle (or are authorised by the owner to commission work on the vehicle) and that the vehicle is not subject to any undisclosed liens, encumbrances, or legal proceedings.
5. Payment Terms
5.1 Payment Before Release
Full payment for all services, repairs, parts, and materials is required before the release of your vehicle. Your vehicle will not be released until payment has been received and cleared in full.
5.2 Repairer's Lien
In accordance with the common law repairer's lien and applicable Western Australian legislation, Apex retains a lien over any vehicle in our possession until all charges relating to the work performed on that vehicle have been paid in full. We reserve the right to retain possession of the vehicle until all outstanding amounts are settled.
5.3 Accepted Payment Methods
We accept the following payment methods:
- Bank transfer (EFT)
- EFTPOS (debit and credit card)
- Cash
Payment by personal cheque is not accepted. Credit card surcharges may apply in accordance with the Reserve Bank of Australia's surcharge standards.
5.4 Overdue Payments
If any amount remains unpaid after the due date, we reserve the right to charge interest at the rate of 2% per month on the outstanding balance. You will also be liable for any costs we incur in recovering overdue amounts, including debt collection fees and legal costs on a solicitor-client basis.
6. Warranty
6.1 Workmanship Warranty
Apex stands behind the quality of our work. Unless otherwise stated, all labour and workmanship is covered by a warranty as specified on your invoice or job card. Warranty periods may vary by service type and will be communicated to you at the time of quoting or invoicing.
6.2 Parts Warranty
Parts supplied by Apex are covered by the manufacturer's warranty. If a part fails within the manufacturer's warranty period, we will assist you in making a warranty claim and, where applicable, arrange replacement or repair at no additional labour cost where the failure is attributable to a manufacturing defect.
6.3 Manufacturer Warranty Claims
Where your vehicle or its components are covered by a manufacturer warranty, we can handle warranty claims on your behalf. Warranty work is tracked on a per-service basis. Please note that warranty claims are subject to the manufacturer's terms and conditions, and approval of the claim is at the manufacturer's discretion.
6.4 Warranty Exclusions
Warranty does not cover:
- Damage caused by misuse, neglect, accident, or failure to follow maintenance recommendations
- Normal wear and tear
- Modifications or repairs performed by third parties after our work was completed
- Parts supplied by the customer (customer-supplied parts are fitted at the customer's risk)
- Consequential or incidental damages
6.5 Customer-Supplied & Third-Party Parts
All parts undergo a visual inspection prior to installation. However, Apex does not guarantee the quality, compatibility, or safety of parts not sourced through us. Customer-supplied parts are fitted at the customer's sole risk, and no warranty applies to labour or workmanship related to the failure of customer-supplied parts.
Where Apex sources parts from third-party suppliers, we work exclusively with reputable Australian distributors and OEM-equivalent suppliers. All reasonable care is taken to verify part suitability before installation; however, Apex is not liable for manufacturing defects in third-party parts beyond the scope of the manufacturer's own warranty.
Apex monitors manufacturer recall notices for parts we have supplied and installed. If a recall is issued affecting parts fitted by us, we will make reasonable efforts to notify affected customers and coordinate the recall process, including replacement or rectification where applicable.
6.6 Consumer Guarantees
Nothing in this section limits or excludes the consumer guarantees provided under the Australian Consumer Law. Services come with guarantees that cannot be excluded, including that services will be provided with due care and skill, will be fit for the specified purpose, and will be completed within a reasonable time.
7. Vehicle Storage
By authorising work, you agree to collect your vehicle promptly upon completion of the work and notification by Apex that the vehicle is ready for collection.
If you fail to collect your vehicle within one (1) business day of being notified that the work is complete and the vehicle is ready for collection, a storage fee of $50.00 per day (inclusive of GST) will apply for each day the vehicle remains on our premises.
We will make reasonable efforts to contact you before storage fees commence. Storage fees will be added to your invoice and must be paid in full before the vehicle is released.
Apex takes reasonable care of vehicles stored on our premises but does not accept liability for damage caused by events beyond our reasonable control (see section 9, Liability).
8. Vehicle Testing
By authorising work, you grant all employees of Apex Service & Repairs permission to operate your vehicle on streets, highways, or elsewhere for the purpose of testing and/or inspection as reasonably required to diagnose faults, verify repairs, or ensure the work has been completed to a safe and satisfactory standard.
Apex will exercise reasonable care when operating your vehicle for testing purposes. Any testing will be conducted by qualified personnel in accordance with all applicable road rules and traffic laws.
9. Liability
9.1 Limitation of Liability
To the maximum extent permitted by law, Apex's total liability to you for any claim arising out of or in connection with our services is limited to the amount you paid for the specific service giving rise to the claim.
To the maximum extent permitted by law, Apex is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use, loss of profits, loss of revenue, loss of enjoyment, or cost of substitute services, arising out of or in connection with our services.
9.2 Customer Responsibilities
You are responsible for:
- Providing accurate and complete information about your vehicle and the work required
- Disclosing any known faults, hazards, or pre-existing damage to your vehicle
- Maintaining appropriate insurance on your vehicle at all times while it is in our possession
- Ensuring your vehicle is registered and roadworthy (where applicable) when delivered to us
- Removing all valuables and personal items from your vehicle prior to drop-off (Apex accepts no liability for loss or damage to personal items left in the vehicle)
9.3 Insurance
Customers are strongly advised to maintain comprehensive insurance on their vehicle at all times, including while the vehicle is in our care. Apex holds appropriate public liability and workshop insurance; however, our insurance does not extend to cover damage to your vehicle caused by pre-existing conditions, defects, or events outside our control.
9.4 Force Majeure
Apex is not liable for any delay or failure to perform our obligations where such delay or failure arises from circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, severe weather, floods, or fire
- Pandemics, epidemics, or government-imposed restrictions
- Supply chain disruptions, parts shortages, or freight delays
- Industrial action, strikes, or labour disputes
- Power outages, telecommunications failures, or IT system failures
- Acts of war, terrorism, or civil unrest
In the event of a force majeure, we will notify you as soon as practicable and work with you to reschedule or find alternative solutions.
10. Booking Cancellations
10.1 Cancellation by Customer
You may cancel a booking at any time by contacting us by phone or email. We appreciate as much notice as possible so we can offer the time slot to another customer.
- Before work commences: No cancellation fee applies. Any deposit paid will be refunded in full.
- After work has commenced: You will be liable for the cost of all work performed and parts ordered or used up to the point of cancellation. Parts ordered specifically for your job that cannot be returned to the supplier will also be charged.
10.2 Cancellation by Apex
We reserve the right to cancel a booking or decline to perform work at our discretion, including (but not limited to) where:
- The vehicle is found to be unsafe or hazardous
- The scope of work materially differs from what was originally described
- Required parts are unavailable or subject to excessive lead times
- A force majeure event occurs (see section 9.4)
If we cancel a booking before work commences, any payments made will be refunded in full.
11. Intellectual Property
All content on the Apex Service & Repairs website (apexserviceandrepairs.com.au), including text, images, graphics, logos, icons, and design elements, is the property of Apex Service and Repairs Pty Ltd or its licensors and is protected by Australian and international intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.
11.1 Digital Infrastructure
The Apex Service & Repairs website, booking system, and digital infrastructure are designed, built, and managed by Re. Analytics (the research and technology arm of Sierra Capital Investment Fund Pty. Ltd.) on behalf of Apex Service and Repairs Pty Ltd. Re. Analytics provides ongoing technical management, security oversight, and system maintenance.
11.2 3D Printing Designs
Where Apex designs and 3D prints custom parts or components for you, the intellectual property in the design remains with Apex unless a separate written agreement is entered into transferring ownership of the design. You receive a licence to use the physical printed part but not the underlying design files.
Where you provide your own design files for 3D printing, you warrant that you own the intellectual property in those designs or have the necessary rights and permissions to have them manufactured.
12. Dispute Resolution
We value our customers and aim to resolve any concerns quickly and fairly.
12.1 Direct Resolution
If you have a complaint or dispute regarding our services, please contact us directly in the first instance. We will make every reasonable effort to resolve the matter promptly and to your satisfaction.
12.2 External Resolution
If we are unable to resolve the dispute directly, you may contact:

- Motor Vehicle Industry Advisory Committee — for disputes relating to motor vehicle repair work
- State Administrative Tribunal (SAT) — for formal dispute resolution under Western Australian law
12.3 Australian Consumer Law
Nothing in this dispute resolution process limits or restricts your rights under the Australian Consumer Law. You retain all rights to pursue remedies available under consumer protection legislation at any time.
13. Privacy
We collect, use, and store your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Personal information collected in the course of providing our services (including your name, contact details, vehicle information, and service history) is used solely for the purpose of delivering our services, communicating with you about your booking, and improving our business operations.
We do not sell or share your personal information with third parties except where necessary to provide our services (e.g., parts suppliers, warranty administrators) or as required by law.

14. Governing Law
These Terms are governed by and construed in accordance with the laws of Western Australia, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Western Australia and any courts of appeal therefrom for the resolution of any dispute arising out of or in connection with these Terms.
15. Changes to These Terms
Apex reserves the right to update or modify these Terms at any time. Changes will be effective from the date they are published on our website. The "Last updated" date at the top of this page indicates when these Terms were most recently revised.
It is your responsibility to review these Terms periodically. Your continued engagement of our services after any changes constitutes acceptance of the revised Terms. Material changes to these Terms will be communicated to existing customers where reasonably practicable.
